Monarchy And Canada -We Control Our Own Destiny
Many Canadians insist , at least they say this to me in conversation and some in writing , that the British Monarchy really run Canada. I mean really control its economic, financial and foreign policy. Of course, the King coming to read the Speech From The Throne confirms it all.
Just some problems:
- I was a First Minister of a Province for 10 years and Minister for another 5 years. I know of no instance where The British Crown was in charge. Think I would know.
- The 1982 Constitution Act had as one its major goals to ensure that all future Constitutional Change would be done in Canada —-and that occurred with the Canada Act and the Amending Formula Provision.
The Canada Act is the first part of the Constitution Act 1982. Section 2 says
‘2 No Act of the Parliament of the United Kingdom passed after the Constitution Act, 1982 comes into force shall extend to Canada as part of its law.’
- The major reason for The Federal Government losing their Constitutional Reference of 1981 was because of the unwritten concept of Constitution Convention . That decision read
‘Conclusion
We have reached the conclusion that the agreement of the provinces of Canada, no views being expressed as to its quantification, is constitutionally required for the passing of the “Proposed Resolution for a Joint Address to Her Majesty the Queen respecting the Constitution of Canada” and that the passing of this Resolution without such agreement would be unconstitutional in the conventional sense.’
Ironically, it was through an unwritten provision of the existing constitution of 1981 that has given us the all Canadian Amending Formula , Section 38 of the written 1982 Act and the written Canada Act .
So , if all else failed ( Canada Act and Amending Formula) which is very unlikely , in the end our independence is confirmed , given the convention of independent Canada decision making of the last many decades.
For starters, What Canada needs is honesty, a basic judaeo christian framework, amendments to our conflict of interest , more parliamentary power and less executive power, an accountable judiciary and an education system-that teaches our constitution , history and hence our form of Government.
